El Cajon Asphalt Paving is a Asphalt Paving Contractor serving El Cajon, CA and surrounding communities. Our services include, but are not limited to, asphalt paving, asphalt sealcoating, parking lot striping, driveway paving, asphalt repair, crack sealing, pothole repair, grading and excavation, concrete curbing and sidewalks, asphalt milling, drainage solutions, and speed bump installation.
Service availability may vary based on location, project scope, scheduling, and other factors. We reserve the right to decline any project at our discretion.
Any estimate or quote provided by El Cajon Asphalt Paving - whether verbal, written, or submitted through our website - is not a binding contract. Estimates are based on information available at the time of assessment and are subject to change if site conditions, project scope, or material costs differ from those assumed in the original estimate.
A written contract signed by both parties is required before any work begins. The contract will specify the scope of work, total price, payment schedule, and any applicable contingencies. Verbal agreements are not binding.
Job dates are confirmed upon execution of a written contract. We make every effort to honor scheduled dates, but circumstances beyond our control - including weather, material availability, or equipment issues - may require rescheduling. We will notify you as soon as possible if a change is necessary.
If you need to cancel or postpone a scheduled job, please notify us at least 48 hours in advance. Cancellations with less than 48 hours notice may be subject to a cancellation fee as specified in your contract. If we have already mobilized equipment or ordered materials for your job, additional costs may apply.
El Cajon Asphalt Paving reserves the right to cancel or suspend work at any time if site conditions are unsafe, if access to the work area is obstructed, or if payment obligations are not met.
Payment terms are set out in the written contract for each job. A deposit may be required before work begins. Final payment is due upon completion of the work as agreed in the contract.
Invoices not paid within the timeframe specified in the contract may be subject to late fees. El Cajon Asphalt Paving reserves the right to pursue collection of unpaid balances through all legal means, including the filing of a mechanic's lien on the property where work was performed, as permitted under California law.
Accepted payment methods will be stated in your contract.El Cajon Asphalt Paving does not accept payment arrangements that were not agreed upon in writing before work began.
Any warranty on workmanship or materials will be stated explicitly in the written contract for your job. Where no specific warranty is stated, work is provided as-is.
Warranties, where applicable, do not cover damage caused by factors outside the contractor's control, including but not limited to: pre-existing base failures, tree root intrusion, ground movement, flooding, improper use of the paved surface, or failure to follow curing and maintenance guidance provided at the time of project completion.

To the fullest extent permitted by California law, El Cajon Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or our services.
Our total liability to you for any claim arising from your use of our services shall not exceed the amount you paid us for the specific service that is the subject of the claim. This limitation applies regardless of the form of the claim, whether in contract, tort, or otherwise.
If a dispute arises between you and El Cajon Asphalt Paving relating to our services or these terms, we ask that you contact us first at contact@elcajonasphaltpaving.com so we have the opportunity to resolve the matter directly.
If the dispute cannot be resolved informally, the parties agree to pursue resolution through binding arbitration in El Cajon, CA, in accordance with the rules of the American Arbitration Association, before initiating any litigation. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction where necessary to prevent irreparable harm.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings that proceed past arbitration shall be conducted in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.
